"Regulations on Management of Public Safety Technologies in Henan Province" issued

On August 1, the Third Session of the Standing Committee of the Twelfth National People's Congress of Henan Province reviewed and adopted the “Regulations on the Management of Public Safety Technologies in Henan Province”, and privacy monitoring at hotels and other private facilities will be punished by the law. From October 1 this year, unauthorized public surveillance videos will be subject to a fine of between 1,000 and 5,000 yuan. To set up surveillance, signs must be affixed to remind citizens to protect their privacy.

The "Regulations" stipulates that technical units, traffic hubs, important facilities, public places, etc. shall install technical protection and monitoring facilities. At the same time, the “Regulations” pay great attention to the protection of citizens’ personal privacy: At the same time as installing technical facilities in public places, clear signs should be set to remind citizens to pay attention to protecting their privacy.

As to whether a technical protection system must be installed in a residential area, the “Regulations” use the word “encourage” and do not make mandatory regulations.

During the deliberation of the “Regulations”, a member of the Standing Committee of the Henan Provincial People’s Congress proposed to increase punishments for private cameras installed in public places and infringe on citizens’ privacy. First, the installation of technical facilities must be approved by the provincial public security authority, and without approval, any organization Individuals are not allowed to install video Surveillance Systems in public areas. The "Regulations" expressly prohibit the installation of video surveillance systems in places such as hotel rooms, public dormitories, public baths, changing rooms, and toilets that involve citizens' privacy, and increase penalties: units and individuals that violate this rule may be ordered by public security agencies at or above the county level to order it. Dismantled and imposed a fine of between 3,000 and 30,000 yuan on units and a fine of between 1,000 and 5,000 yuan on individuals.

If the surveillance video management personnel privately put videos captured by cameras in the park and on the road, they will also be punished.

The "Regulations" stipulates that no unit or individual may buy, sell, distribute, or review and copy the information collected and maintained by the computer room system without the public security agency's notice. Public security agencies at or above the county level may impose a fine of 5,000 to 30,000 yuan on units that violate the regulations and a fine of 1,000 to 5,000 yuan on individuals.
